Certificate of compliance for regulated rent (canone concordato) in Trieste: who issues it and how to apply

If landlord and tenant draw up a regulated-rent lease on their own, without the assistance of the associations, one more document is needed for the tax benefits: the certificate of compliance (attestazione di rispondenza). Here you will find what it is for, who issues it under each of Trieste’s two agreements, what to bring and what happens if the lease is already registered.

What it is for

The certificate of compliance is a document in which a landlords’ or tenants’ association declares that your lease matches the local rent agreement: rent within the range, the right lease model, increases applied correctly. It checks the details you give it, and whoever declares them is responsible for them.

It is provided for by the ministerial decree of 16 January 2017 of the Minister of Infrastructure, issued jointly with the Minister of Economy (D.M. 16/01/2017), for all three regulated-rent leases: the 3+2 (article 1, paragraph 8), the transitional lease (article 2, paragraph 8) and the university student lease (article 3, paragraph 5). It concerns non-assisted leases: those that landlord and tenant draw up without the assistance of the associations.

What it gets you

According to the Agenzia delle Entrate, the Italian Revenue Agency (resolution 31/E of 20 April 2018), for non-assisted leases the certificate is necessary to get:

  • the flat-rate tax (cedolare secca) at 10% instead of 21%;
  • if you stay under ordinary taxation, 30% less taxable rental income for income tax (IRPEF, the personal income tax) and the registration tax calculated on 70% of the rent.

«obtaining the certificate is a necessary condition for the benefits to be granted»

Agenzia delle Entrate, resolution no. 31/E of 20 April 2018 (our translation)

In Trieste it also counts for ILIA, the property tax that in Friuli Venezia Giulia took the place of IMU. The City’s regulation grants the reduction only to leases with the certificate, which must be attached to the ILIA declaration, and it makes no distinction between assisted and non-assisted leases. The benefits, one by one, are in cedolare secca and ILIA.

The sources we have read link the certificate to the tax benefits, not to the validity of the lease. But the rent must stay within the agreement in any case: in a 3+2, a clause setting the rent above the maximum is void (art. 13, paragraph 4, of Law 431/1998).

Who issues it: it depends on the agreement

Two agreements are in force in Trieste. For a new lease, as we read the texts, you choose one agreement and apply it in full; the certificate is issued by an association that signed that agreement, or has adhered to it. A lease signed between 15 December 2022 and 15 December 2025 stays on the 2022 agreement. Why you can choose, and with what risks (no court has ruled on Trieste), we explain in 2022 or 2025.

Agreement of 15 December 2025

Filed on 15/12/2025; applies to leases signed from 16/12/2025. Tutelati.casa adhered, notified to the City on 13/08/2026 (stated start date: 11/08/2026). The certificate of compliance is issued by one of these associations.

Agreement of 14 December 2022, extended

Supplemented on 23/01/2023; extended by the protocol of 11/12/2025 “until a new ministerial decree is adopted”. The certificate of compliance is issued by one of these associations.

Under the 2025 agreement

  • It is issued by one of the signatory landlords’ or tenants’ associations, or by two together (article 10).
  • Only the model attached to the agreement may be used (Annex 3). The request is made with Annex 2.
  • An association that did not sign may issue certificates only after adhering to the agreement (article 19), and only from the date its adherence takes effect. Adherence does not work retroactively. Tutelati.casa adhered with effect from 11 August 2026, according to the notice sent to the City on 13 August; article 19, however, makes adherence take effect from that notice. Leases signed earlier are certified by the five original signatories; for one signed between 11 and 13 August 2026, ask for confirmation.
  • It is valid only with the qualified digital signature of the issuer. Under the agreement, a certificate with a scanned handwritten signature is not valid.

Under the 2022 agreement

  • It is issued by a signatory landlords’ or tenants’ association, or by two together, using the model in Annex 4. The request is Annex 5.
  • For the City, the extension of 11 December 2025 applies to the nine associations that signed it: they are the ones issuing it today. FE.N.I.T., which joined the 2022 signatories in January 2023, did not sign the extension and signed the 2025 agreement.
  • The 2022 text does not require a digital signature.

How to apply, step by step

  1. Sign the lease on the right ministerial model, naming the agreement you have chosen: Annex A for the 3+2, Annex B for the transitional lease, Annex C for students. They must be used without changes that alter their structure or content (2025 agreement, article 11). You can prepare a draft with our lease generator, to be checked against the model before signing.
  2. Choose the association among those that signed the chosen agreement, or have adhered to it. Ask it first about costs, timescales and which documents it wants.
  3. Fill in the request: for 2025, Annex 2, which the landlord or the tenant can submit; for 2022, Annex 5, written for the landlord. The 2022 agreement also has the sub-band sheet (Annex 3), with a space for a signature: ask whether they want it filled in.
  4. Hand in the documents listed below. If they are not enough, the association can ask for more (2025 agreement, article 10).
  5. Keep the certificate: you need it in case of an inspection, and it must be attached to the ILIA declaration.

The documents

The 2025 agreement asks for four things (article 10):

  • the request for the certificate (Annex 2), filled in and signed;
  • the signed lease, complete in every part, and already registered if the deadline for registering it has passed;
  • a copy of the requester’s identity document;
  • any other document useful for checking that the lease complies with the agreement.

In Annex 2 you enter the parties’ details with their tax codes, the details of the home and of the lease (with the registration references), and then the whole calculation: weighted floor area, increases, the 30 parameters, zone, band, range and the rent set by the parties. At the end you sign formal self-declarations: you declare that the details are true, and you are responsible for them.

In practice, have ready: the net floor area in square metres (not the cadastral area) and that of balconies, cellar and garage; the cadastral category; the APE (the energy performance certificate, attestato di prestazione energetica) if you apply the energy increase (its number, date and class go into the lease); the inventory of furnishings attached to the lease, if you apply the furnishing increase; for a transitional lease, the documents proving the need that justifies it.

For the 2022 agreement the request (Annex 5) asks for similar details: the parties with tax code and residence, the home with cadastral category and class, the lease, the floor areas, the band, the increases, and the reductions with their reasons. The lease is attached to the form.

Timescales and costs

The agreements do not say how much the certificate costs, how long it takes or whether you have to join the association, and no official source publishes it. Ask the association before handing in the documents.

If the lease is already registered

You can still ask for it. The forms of both agreements have a space for the registration references, or the box “in corso di registrazione” (registration in progress). The 2025 agreement wants the lease already registered only if the deadline for registering it has passed.

Attaching it to the lease when you register it is not compulsory. For the Agenzia delle Entrate, however, it is “advisable” (opportuna) if you claim the registration tax on 70% of the rent. And it costs nothing extra: the attached certificate pays neither registration tax nor stamp duty (resolution 31/E of 2018).

Do you need another certificate with a new tenant?

Not always. Since 2022 the law says that the certificate also applies to leases signed later, if they have the same content as the certified one, until the features of the home or the local rent agreement change (art. 7 of Decree-Law 73/2022).

The Agenzia delle Entrate explained this in circular 15/E of 2023: a different tenant or a different rent does not count, as long as the rent stays within the agreement’s limits. A new local rent agreement and changes to the home do count: floor area, parking space, balconies, terraces, lift. In Trieste this means:

  • a certificate under the 2022 agreement does not cover a new lease calculated under the 2025 agreement: it is a different agreement;
  • if the new lease changes in other ways (type of lease, term, furnishing, increases), the circular does not say: ask the association whether the certificate still covers it;
  • for a new lease under the 2022 agreement, no source says whether a “change to the agreement” includes the extension of 11 December 2025, the tables updated with the price index of ISTAT (the Italian national statistics institute) or the arrival of the 2025 agreement, which for the City has not taken the place of the 2022 one. This too must be asked.

If a dispute arises: the joint committee

For disputes over how the agreement is applied, the 2025 agreement provides for a joint negotiation committee (article 18). The landlord turns to a signatory landlords’ association, the tenant to a tenants’ one. Only the costs of documents are paid. The 2022 agreement also has a conciliation committee.

Frequently asked questions

Is the certificate compulsory? Can you do without it?

The lease can be signed without it. But if it is made without the assistance of the associations, the certificate is necessary for the 10% flat-rate tax (cedolare secca), for income tax (IRPEF) reduced by 30% and for registration tax on 70% of the rent (resolution 31/E of 2018). For reduced ILIA, Trieste’s regulation requires it without distinguishing between assisted and non-assisted leases.

How much does the certificate cost? Do you have to join?

The agreements do not say, and no official source publishes a price. Ask the association about cost, timescales and any membership before handing in the documents.

Does it also apply to transitional and student leases?

Yes: the 2017 decree provides for it for all three leases. For a transitional lease, also bring the documents proving the need that justifies it. See the transitional lease and students.

Can the tenant ask for it?

Under the 2025 agreement, yes: it is requested by “the interested party” (la parte interessata), landlord or tenant. The 2022 request form is written for the landlord.

If I change tenant, do I need a new one?

Not necessarily. If the new lease has the same content, the agreement is the same and the home has not changed, the law allows the same certificate to be used (art. 7 of Decree-Law 73/2022). If in doubt, ask whoever issued it.
